Football Agents and Commission

DID YOU KNOW THAT….

…..A player does not have to pay an agent any commission where he/she concluded their employment contract without the involvement of the agent.

In the past, it would have been very unusual to come across a representation contract between a football agent and a player that didn’t have a clause stating that the agent would be entitled to a commission, irrespective of whether or not, they were involved in the player’s employment contract negotiations 😲.

This is somewhat understandable if the parties have signed an exclusive contract and the agent is trying to deter the player from breaching their contract by using the services of another agent, but what about where the player has negotiated his own contract?

Well, the new FFAR states that any clause in a representation agreement that penalises an individual for concluding an employment contract, without the involvement of an agent is null and void.

So there you have it… hopefully that’s cleared things up. If you are an agent and you insert such a clause into a representation contract, it will be unenforceable, even if signed by the player 😁.
